Terms of Service
The agreement between your business and Birsend: what we provide, what you commit to, and how either side can end it.

This document is written to be readable rather than to serve as legal advice. Have your own counsel review it before you rely on it in production.
The agreement
By creating an account you accept these terms on behalf of your business. If you do not have authority to bind your business, do not use the service.
What we provide
Birsend provides a dashboard and infrastructure to connect a WhatsApp number, import contacts, compose personalised templates, schedule campaigns, and manage replies in a shared inbox. Features available to you depend on your plan.
We aim for 99.9% monthly availability excluding scheduled maintenance, which we announce at least 24 hours ahead.
Your account
- You are responsible for the accuracy of your account details and for keeping credentials confidential.
- You are responsible for everything done under your account, including by your team members.
- You must tell us promptly if you suspect unauthorised access.
Acceptable use
Birsend sends from your own number, so how you use it directly affects that number. You agree not to:
- Message anyone who has not given you permission to contact them.
- Upload purchased, scraped, or otherwise unlawfully obtained contact lists.
- Send content that is unlawful, deceptive, defamatory, or that infringes someone else's rights.
- Use the service for phishing, malware distribution, or impersonation.
- Attempt to bypass sending limits, rate controls, or consent checks.
- Reverse engineer, resell, or sublicense the service without written permission.
Dependence on WhatsApp
Birsend is an independent product and is not affiliated with, endorsed by, or sponsored by WhatsApp LLC or Meta. The service depends on WhatsApp remaining available and on your compliance with WhatsApp's own terms. We cannot guarantee that a number will never be restricted by WhatsApp, and restrictions imposed by WhatsApp are outside our control.
Fees and billing
- Plans are billed in advance, monthly or annually, in the currency shown at checkout.
- Message allowances reset at the start of each billing period and do not roll over.
- Exceeding your allowance does not stop sending; you may purchase a top-up or move up a plan.
- Fees are exclusive of taxes, which are added where applicable.
- We may change prices with 30 days' notice, effective at your next renewal.
Free trial
New accounts may use a 14-day trial without a payment method. Trials carry lower sending limits. We may end a trial early where we detect abuse.
Cancellation and termination
You can cancel at any time from the dashboard. Cancellation takes effect at the end of the current billing period; we do not refund partial periods unless required by law. You can export your data at any point before deletion.
We may terminate for material breach if you do not remedy it within 14 days of notice, or immediately for the conduct described under Acceptable use.
Warranties and liability
The service is provided "as is". To the extent permitted by law we exclude implied warranties. Our total liability in any 12-month period is limited to the fees you paid in that period. We are not liable for indirect or consequential loss, including lost profits, lost goodwill, or action taken against your number by WhatsApp.
Governing law
These terms are governed by the laws of the jurisdiction in which Birsend is established, and disputes are subject to the exclusive jurisdiction of its courts.
